We are SportsAnalytics, LLC, the owner of the TennisLocker smartphone application (the “TennisLocker App”). You are viewing this Privacy Policy because

 

  • either a tennis academy or tennis club (an “Academy”) or a tennis coach (a “Subscribing Coach”) at a school, college or university, has subscribed to the TennisLocker App (such Academy or such Subscribing Coach being referred to in this Privacy Policy as “the Subscriber”);
  • either the Subscribing Coach or one of the Academy’s tennis coaches (in either case, the “Coach”) identified you to us as a tennis player whom the Coach wishes to use the TennisLocker App in your lessons with the Coach, group lessons and fitness sessions; and
  • the Coach then sent you an invitation to use the TennisLocker App, granted you access and emailed or texted you the necessary username and password, and you have opened the TennisLocker App on your smartphone.

We are committed to protecting and respecting the privacy of TennisLocker App users. This Privacy Policy describes how we have collected or may collect personal information about you, what that information may be and how we may use and disclose your personal information.

 

In order to use the TennisLocker App, you must check the box displayed in the previous screen, indicating that you have read this Privacy Policy and agree to be bound by it. If you fail to check the box, you will not be able to login to your Tennis Locker account and thus not be able to use the App.

 

INFORMATION WE MAY COLLECT FROM YOU

 

The Coach has created a TennisLocker account for you, which includes a profile (your “Profile”). Your Profile includes personal information about you that may identify you as an individual or allow online or offline contact with you as an individual (“Profile Collected Information”).

Profile Collected Information includes your name, gender, height, weight, shoe size, t-shirt size; information about your rankings and ratings (sectional, national,

UTR); information about your game style (game type, dominant hand, backhand); and ‘bag check information’ (racquet brand, string brand, grip size, racquet head size and string tension, and shoe brand).

Your Profile Information is available through the TennisLocker App to Academy coaches and to us.

We may also collect information about the device(s) on which you open the App, such as operating system version, device type, and system performance information (“Device Information”). Device Information may be collected via the tracking technologies described below under “Tracking Technologies”.

The TennisLocker App also lets the Coach collect, store, analyze, evaluate, display and transmit the following information about your tennis (your “Individual Performance Data”):

  • the Coach’s daily evaluations of your performance,
  • your attendance,
  • your fitness test results,
  • your practice match scores, and
  • detailed information about your participation in tournaments, including, your win/loss results, the identity of your doubles partners and your opponents;
  • your personal tennis goals; and
  • your leaderboards of the above.

Profile Collected Information, Device Information and Individual Performance Data are referred to collectively as “Collected Information”. We will collect no personal information from you other than Collected Information in connection with your use of the TennisLocker App.

CONFIDENTIALITY AND SECURITY

The security of your Collected Information is important to us. We follow generally accepted standards to protect the Collected Information submitted to us, both during transmission and once it is received (for more specific information, see “Where We Store Your Collected Information”, below. If you have any questions about the security of your personal information, you can contact us at support@tennislockerapp.com.

Other than as specified in this Privacy Policy, we will not provide your personal information to any third party without your specific consent.

TRACKING TECHNOLOGIES

The TennisLocker App uses Google Firebase Analytics (“Google Analytics”) code to gather statistical information. Google Analytics sets cookies to help us accurately estimate how much time you spend using the TennisLocker App, and which screens within the TennisLocker App you use most. This is done to ensure that the App functions as expected, ensuring that features are available when you want them and that they load and function fast. Mobile Analytics.

We use mobile analytics software to allow us to better understand the functionality of the TennisLocker App on your phone. This software may record information such as how often you use the TennisLocker App and the events that occur within the TennisLocker App.

Log Files.

We may gather certain information automatically and store it in log files. This information may include Internet Protocol (IP) addresses, internet service provider (ISP), operating system, and date/time stamp.

Where We Store Your Collected Information.

All information we collect through the TennisLocker App is encrypted using SSL technology and stored on our secure servers located in the US. Any payment transactions will be encrypted using SSL technology.

The transmission of information via the internet (including email) is not completely secure. Although we will do our best to protect your personal information, we cannot and do not guarantee the security of any information transmitted over the internet; any such transmission is solely at your own risk. Once we have received your information, we will follow and rely exclusively on our platform provider, Microsoft Azure, including its proprietary procedures and security features, to prevent unauthorized access to your stored Collected Information. However, we cannot and do not guarantee the security of any information that we store.

ACCESS TO AND DELETION OF COLLECTED INFORMATION

You may access your Profile Collected Information at any time through the TennisLocker App, or by emailing support@tennislockerapp.com.

You may only use the App while your Collected Information remains on file with us. You may request that we delete it, by emailing us at support@tennislockerapp.com, and we will respond to your request reasonably promptly. But any deletion will result in your access to the TennisLocker App being blocked.

USES MADE OF YOUR COLLECTED INFORMATION

We may use your Collected Information in one or more of the following ways:

The Coach (and other coaches at the Academy) will use Profile Information and your Individual Performance Data to help develop you as a competitive tennis player.

Only the Coach can enter your Individual Performance Data into the TennisLocker App. After entering your Individual Performance Data, the Coach can use the TennisLocker App to aggregate it with other players’ Individual Performance Data for analytical and comparison purposes (“Aggregated Data”). The Coach may make Aggregated Data available to other Academy tennis players whom he coaches and/or to other tennis coaches who work at or for the Academy. The Coach will make your Individual Performance Data, and any Aggregated Data that (s)he develops, available to the management of her/his Academy. The Coach is contractually prohibited by his/her acceptance of our Terms of Service from making any use of your Collected Information (without your prior written consent), or of any Aggregated Data, for any purpose not described in this paragraph.

 

After stripping it of any information that could be used to identify you or any other Player, we may make your Individual Performance Data and your Player Profile and/or Aggregated Data available to:

  • manufacturers or distributors of branded tennis equipment, tennis apparel, shoes, foods and/or beverages, and/or
  • the tennis player development staff of local, sectional and/or national professional tennis organizations.

More generally, we may use your Collected Information:

To ensure that App content is presented in the most effective manner for you and for your device.

To provide you with information, products or services about us, that you request from us or which we feel may interest you, unless you have requested that we not provide this information.

To provide you with customer service communications.

To allow you to participate in interactive features of the App, when you choose to do so.

To notify you about changes to the App.

To understand your broad, non-specific geographic location to help us identify groups of users by general geographic market (such as zip code, state or country).

We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to such requests.

Details of your interactions with the App including, but not limited to, screen usage data, location data, App logs and other communication data.

We do not disclose information about identifiable individuals to companies that advertise with us, but we may provide them with aggregate information about our users (for example, we may inform them that 500 male players aged under 18 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target.

Without your advance, written consent, we will make no other use of your Collected Information.

NEWSLETTERS OR OTHER ELECTRONIC COMMUNICATIONS

Your Academy or Coach has enrolled you in our email communication list. You may therefore receive email newsletters or promotional materials from us. If you respond, we will use the information you give us in such responses to provide the communications you have requested in such response(s).

If you inform us that you wish to cancel email newsletters or promotional materials by selecting unsubscribe at the bottom of such communication or by emailing us at unsubscribe@tennislockerapp.com, we will remove you from our mailing list. If you no longer wish to receive push notifications, you may turn them off at the device level.

LINKS TO THIRD PARTY SITES

The App may, from time to time, display links to websites of our partner networks, advertisers and affiliates. If you follow a link to any of these external websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these websites or their policies. Please check these policies before you submit any personal information to these external websites.

CHANGES TO OUR PRIVACY POLICY

We may update this Privacy Policy to reflect changes to our practices. If we make any material changes we will notify you via the App or by email (sent to the e-mail address that appears in your Profile) or by means of a notice in the Products prior to the change becoming effective or concurrently with its effectiveness.

THIS PRIVACY POLICY BINDS YOU

This privacy policy governs our collection and use of your Collected Information. You understand that through your use of the TennisLocker App and/or the Website you consent to the collection and use (as set forth above) of any information about you that is described above.

CONTROLLING LAW AND JURISDICTION

This Privacy Policy and any action related thereto will be governed by the laws of the State of Texas without regard to or application of its conflict of law provisions or your state or country of residence and without regard to your geographical location at any time when you open the App. All claims, legal proceedings or litigation arising in connection with the Tennis Locker App will be brought solely in the federal or state courts located in Dallas County, Texas, United States, and you consent to the jurisdiction of and venue in such courts and waive any objection to such venue based on inconvenience to you (the doctrine of forum non conveniens).
